Terms and Conditions
Introduction
Welcome to Campervan Bible.
These Terms and Conditions govern your access to and use of the Campervan Bible website, mobile application and all related products, features and services that we make available from time to time.
They set out the rights and responsibilities that apply when you use our platform and form a legally binding agreement between you and Campervan Bible. By creating an account, purchasing a membership, accessing the mobile application or otherwise using any part of our services, you confirm that you have read these Terms and Conditions, understood them and agree to be bound by them.
If you do not agree with these Terms and Conditions, you should not access or use the Campervan Bible platform.
Campervan Bible is designed to help users discover, organise and share information relating to campervan and motorhome travel. Our services continue to develop over time and new features, tools and functionality may be introduced, updated or withdrawn where this is reasonably necessary for operational, technical, legal or commercial reasons.
Some features or services may be subject to additional terms, policies or guidelines. Where this applies, those documents will form part of these Terms and Conditions for the relevant service or feature.
These Terms and Conditions should be read together with our Privacy Policy, Cookie Policy and any other policies expressly referred to within them. Together, these documents set out the legal framework governing your use of the Campervan Bible platform, explain how your personal information is handled and describe the rights and responsibilities that apply when you use our services.
We recommend that you keep a copy of these Terms and Conditions for future reference, as they contain important information about your rights, your responsibilities and the legal relationship between you and Campervan Bible.
About Campervan Bible
Campervan Bible is an online platform created to help people discover, plan and enjoy campervan and motorhome travel. Through our website and mobile application, users can explore locations, organise trips, save favourite places, share experiences and access a range of features designed to make travelling easier and more enjoyable.
The services available through the platform may include interactive maps, route planning tools, saved locations, venue information, user reviews, photographs, membership features and other functionality that we choose to make available from time to time. The exact features available to you may depend on your subscription, your device and the version of the application you are using.
We are continually improving our services. As our platform develops, we may introduce new features, improve existing functionality, modify the way certain services operate or discontinue features that are no longer appropriate. Where reasonably practicable, we will aim to minimise any unnecessary disruption to users.
Campervan Bible brings together information from a variety of sources, including content provided by members of our community. While we make reasonable efforts to maintain a reliable and useful platform, we cannot guarantee that every location, review, recommendation, photograph or other item of content will always be accurate, complete, current or available.
You remain responsible for assessing whether any information available through the Campervan Bible platform is suitable for your own circumstances before relying upon it.
Eligibility
The Campervan Bible platform is intended for individuals who are legally capable of entering into a binding agreement under the laws that apply in their country or jurisdiction.
By creating an account, purchasing a membership or using our services, you confirm that you have the legal capacity to accept these Terms and Conditions and to comply with the obligations set out within them.
If you are accessing the Campervan Bible platform on behalf of a company, organisation or other legal entity, you confirm that you have the authority to accept these Terms and Conditions on its behalf. In those circumstances, references to "you" within these Terms include both you as the individual using the platform and the organisation that you represent, where appropriate.
You are responsible for ensuring that your use of the Campervan Bible platform complies with all laws, regulations and requirements that apply to you. If access to our services is restricted or prohibited in your jurisdiction, you should not use the platform.
We may refuse, suspend or restrict access to the Campervan Bible platform where we reasonably believe that this is necessary to comply with legal obligations, protect the security or integrity of our services, prevent misuse of the platform or safeguard the interests of our users and business.
Creating an Account
Some features of the Campervan Bible platform are available only to registered users. To access those features, you will need to create an account.
When registering, you agree to provide information that is accurate, complete and kept up to date. This helps us provide our services, communicate with you where necessary and maintain the security of your account.
You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to prevent unauthorised access to your account. Unless we have expressly agreed otherwise, your account is personal to you and should not be shared with another individual or used by anyone else.
You are responsible for activity carried out through your account unless you have previously notified us that your account security has been compromised or we have otherwise confirmed that unauthorised access has occurred.
If you believe that someone has gained access to your account without your permission, or if you suspect that your login credentials have been lost, stolen or misused, you should notify us as soon as reasonably practicable so that appropriate security measures can be taken.
From time to time, we may ask you to verify certain account information where this is reasonably necessary to protect your account, comply with legal obligations or investigate suspected misuse of the platform.
We may suspend, restrict or close an account where we reasonably believe that these Terms and Conditions have been breached, fraudulent or unlawful activity has taken place, false information has been provided or continued access could present a risk to our users, our services or our business. Where reasonably practicable, we will explain the reasons for our decision and give you an opportunity to resolve the issue before permanent action is taken.
Account Security
Protecting user accounts is important to us, and we take reasonable technical and organisational measures to help maintain the security of the Campervan Bible platform. At the same time, keeping your account secure is a shared responsibility.
You should choose a strong password, keep your login credentials confidential and avoid using the same password for multiple online services. If you believe that your account credentials may have been lost, disclosed or compromised, you should change your password immediately and notify us as soon as reasonably practicable.
Where additional security features are available, including multi-factor authentication or other account protection measures, we encourage you to make use of them.
We are not responsible for losses resulting from unauthorised access to your account where this arises because you failed to take reasonable steps to protect your login credentials or your device.
If we identify activity that appears unusual, suspicious or inconsistent with the normal use of your account, we may temporarily restrict access while appropriate security checks are carried out. Where reasonably practicable, we will notify you of the action taken and restore access as soon as we are satisfied that your account can be used safely.
We may also introduce additional security measures from time to time where this is reasonably necessary to protect our users, respond to emerging security risks or improve the overall security of the Campervan Bible platform.
Changes to Your Account
You can review and update your account information at any time through your account settings where this functionality is available. Keeping your information accurate helps us provide our services, communicate with you where necessary and maintain the security of your account.
If you decide that you no longer wish to use the Campervan Bible platform, you may close your account by following the account deletion process within the application or by contacting us directly.
Closing your account does not automatically cancel an active membership or subscription. If you have purchased a recurring subscription through Stripe, PayPal, the Apple App Store, Google Play or another authorised payment provider, you must also complete the relevant cancellation process in accordance with the subscription terms that apply to your purchase.
Once your account has been closed, access to your account and any associated features will normally end, subject to any remaining subscription rights or other arrangements that continue to apply.
In certain circumstances, we may continue to retain limited information after your account has been closed where this is reasonably necessary to comply with legal obligations, resolve disputes, investigate suspected fraud, enforce these Terms and Conditions or protect our legal rights. Further information about the way we retain personal information is available in our Privacy Policy.
Memberships and Subscriptions
Some areas of the Campervan Bible platform are available only through a paid membership.
An active membership gives you access to the features, content and services included within the subscription plan that you have selected. The functionality available under each plan may vary and may change over time as we continue to develop and improve our services.
Information about available membership plans, subscription prices, billing periods and included features will be presented before you complete your purchase. It is your responsibility to review this information carefully before subscribing.
By purchasing a membership, you confirm that the information provided during the purchase process is accurate, that you are authorised to use the chosen payment method and that you agree to pay the applicable subscription fees.
Your membership will normally become active once payment has been successfully authorised and confirmed by the relevant payment provider. In some circumstances, access to paid features may be delayed until payment verification has been completed.
Memberships are provided for your personal use only unless we have expressly agreed otherwise in writing. They may not be transferred, shared, assigned, sublicensed or resold to another person or organisation.
From time to time, we may offer promotional pricing, introductory offers or other discounts. Unless we expressly state otherwise, these offers apply only for the promotional period identified at the time of purchase and do not create any ongoing entitlement to discounted pricing or future promotional offers.
Payments
Payments for memberships and subscriptions are processed securely through trusted third-party payment providers, including Stripe and PayPal. Depending on how you choose to subscribe, payments may also be processed through the Apple App Store or Google Play, where the relevant app store acts as the payment provider.
By completing a purchase, you authorise the applicable payment provider to charge your chosen payment method for the subscription fees, together with any taxes or other charges that are required by law.
Campervan Bible does not collect, receive or store your full payment card details. Payment information is handled directly by the relevant payment provider in accordance with its own terms, privacy practices and security standards.
It is your responsibility to ensure that your payment information remains valid and up to date throughout your subscription. If a payment cannot be authorised or successfully processed, we may suspend access to paid features until payment has been received or the issue has been resolved.
From time to time, payment providers may carry out their own security, fraud prevention or identity verification checks before approving a transaction. Campervan Bible is not responsible for delays or failed transactions resulting from those independent verification processes.
Although we take reasonable care to ensure that pricing information is accurate, genuine pricing errors or technical mistakes may occasionally occur. If this happens and it affects your purchase, we will notify you before taking any further payment or processing the order, giving you the opportunity to decide whether you wish to proceed.
Subscription Renewals
Unless we expressly state otherwise at the time of purchase, memberships are provided on a recurring subscription basis.
Your subscription will automatically renew at the end of each billing period unless you cancel it before the next renewal date. Renewal allows you to continue accessing the features and benefits included within your membership without interruption.
By purchasing a recurring subscription, you authorise the relevant payment provider to charge your selected payment method automatically for each renewal until your subscription is cancelled in accordance with these Terms and Conditions or the applicable payment provider's procedures.
Renewal payments will normally be processed using the payment method linked to your subscription. If a payment cannot be authorised or successfully completed, we may suspend access to paid features until payment has been received or an alternative payment method has been provided.
Where subscriptions are purchased through the Apple App Store, Google Play or another third-party marketplace, renewals, billing and payment processing may also be subject to the terms, policies and procedures of the relevant platform.
We may review and change our subscription prices from time to time. Where a change affects an existing recurring subscription, we will provide reasonable notice before the new price takes effect where required by applicable law or the policies of the relevant payment provider or app store. If you do not agree with the revised pricing, you may cancel your subscription before the next renewal date.
Cancelling Your Subscription
You may cancel your subscription at any time.
The way you cancel your subscription will depend on how it was purchased. In most cases, cancellation can be completed through the payment provider used to purchase your membership, through your account settings where this option is available or by following the subscription management process provided by the Apple App Store, Google Play or another authorised marketplace.
Cancelling your subscription prevents future renewal payments but does not normally affect the current billing period that has already been paid for. Unless required by applicable law or expressly stated at the time of purchase, subscription fees are not refunded simply because you choose to cancel before the end of the current subscription period.
Following cancellation, your membership will remain active until the end of the billing period for which payment has already been received. Once that period expires, your access to subscription features will end automatically unless you choose to subscribe again.
Deleting your Campervan Bible account does not automatically cancel an active subscription. Where your subscription is managed by Stripe, PayPal, the Apple App Store, Google Play or another authorised payment provider, you must complete the relevant cancellation process through that provider.
If you experience any difficulty cancelling your subscription, you are welcome to contact us. While we cannot cancel subscriptions that are managed directly by third-party payment providers, we will do our best to help you understand the appropriate cancellation process.
Refunds and Cooling-Off Rights
Your rights in relation to refunds and cancellations depend on how your subscription was purchased, the payment provider used to process the transaction and the consumer protection laws that apply to your purchase.
Where UK or European consumer protection legislation provides a statutory cooling-off period for digital content or digital services, you acknowledge that this right may be affected if you have expressly requested immediate access to the service and confirmed that performance should begin before the cooling-off period has expired. Where this applies, your statutory cancellation rights may end once the service has been activated, to the extent permitted by applicable law.
Nothing in these Terms and Conditions limits or excludes any statutory rights that you are entitled to under applicable consumer protection legislation.
If you believe that you are entitled to a refund, you should contact us or the relevant payment provider as soon as reasonably practicable. Each request will be considered on its own circumstances, taking into account the applicable law, the terms governing the payment method used for the purchase and any policies of the relevant payment provider or app store.
Where refunds are approved for payments processed directly through Stripe or PayPal, they will normally be returned to the original payment method. If your subscription was purchased through the Apple App Store, Google Play or another third-party marketplace, refunds are generally administered by that platform and may be subject to its own refund procedures and eligibility requirements.
If you have any questions about your subscription or believe that a payment has been made in error, you are welcome to contact us. We will always do our best to assist you and, where appropriate, direct you to the correct payment provider or app store.
Acceptable Use
We want Campervan Bible to remain a safe, respectful and enjoyable platform for everyone. By using our services, you agree to act responsibly, respect the rights of other users and use the platform only for lawful purposes.
You must not use the Campervan Bible platform in a way that interferes with its normal operation, compromises its security or prevents other users from enjoying the services.
Content shared through the platform must not be unlawful, misleading, fraudulent, defamatory, threatening, abusive, discriminatory, obscene or otherwise inappropriate. You are responsible for ensuring that anything you upload, publish or share complies with applicable law and does not infringe the intellectual property, privacy or other legal rights of another person.
The Campervan Bible platform must not be used to distribute spam, unsolicited commercial communications, malware, malicious software or any material designed to disrupt, damage or interfere with our services or the systems that support them.
You must not impersonate another individual or organisation, provide false or misleading information about your identity or suggest that you are associated with Campervan Bible or any third party unless this is genuinely the case.
Attempts to gain unauthorised access to user accounts, connected systems, databases or other parts of the platform are strictly prohibited. This includes attempting to test, scan or bypass security measures without our prior written permission.
Unless we have expressly authorised it, you must not use automated software, bots, scripts, data extraction tools or similar technologies to access, monitor, copy or collect information from the Campervan Bible platform.
If we reasonably believe that your conduct or the content you have submitted breaches these Terms and Conditions, creates a security risk or may adversely affect other users or our services, we may remove the content, restrict access to some or all of the platform or suspend or terminate the relevant account. Where reasonably practicable, we will explain the reasons for our decision and give you an opportunity to resolve the issue before permanent action is taken.
User Content
Some features of the Campervan Bible platform allow you to create, upload, publish or share content with other members of the community. This may include reviews, ratings, comments, photographs, venue information, travel recommendations, saved routes and other material that you choose to contribute.
You retain ownership of the content that you create and submit. Nothing in these Terms and Conditions transfers ownership of your intellectual property to Campervan Bible.
In order to operate the platform and make your content available to other users, you grant Campervan Bible a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute and otherwise use your content for the purposes of operating, maintaining, improving and promoting the Campervan Bible platform.
This licence continues only for as long as it is reasonably necessary to provide the services or until the relevant content has been removed, except where we are required to retain certain information to comply with legal obligations, resolve disputes, investigate misuse of the platform or protect our legal rights.
You are responsible for the content that you submit and for ensuring that you have all necessary rights, permissions and authority to upload, publish or share it. Where your content includes photographs, personal information or other material relating to another individual, you are responsible for ensuring that you have the necessary permission or other lawful basis to make that information available through the platform.
Although we may monitor user-generated content for moderation, security or legal compliance purposes, we do not routinely review every item of content before it is published. For that reason, Campervan Bible does not endorse user opinions and cannot guarantee that content submitted by members of the community will always be accurate, complete or reliable.
We reserve the right to remove or restrict access to user content where we reasonably believe that it breaches these Terms and Conditions, infringes the rights of another person, creates legal or regulatory risk or is otherwise inconsistent with the safe and responsible operation of the Campervan Bible platform.
Reviews and Community Content
The Campervan Bible platform is built around a community of users who share their experiences, recommendations and knowledge to help others make informed travel decisions.
We encourage all reviews, ratings, photographs and other community contributions to be honest, accurate and based on genuine personal experience. Content should relate to the location, service or experience being described and should not be misleading, fabricated or intended to manipulate ratings, search results or the experience of other users.
You remain responsible for the information that you choose to publish through the platform. Campervan Bible does not endorse individual opinions, recommendations or reviews and cannot guarantee that community content will always be accurate, complete or suitable for every user's circumstances.
To help maintain a safe and trustworthy community, we may review reported content and take action where we reasonably believe that material breaches these Terms and Conditions, infringes the rights of another person, contains unlawful, offensive or misleading content or has otherwise been submitted in bad faith.
Where content is removed, we may continue to retain relevant information where this is reasonably necessary to comply with legal obligations, investigate suspected misuse of the platform, resolve disputes or protect our legal rights.
Repeated or serious misuse of the community features may result in the removal of content, restrictions on your account or the suspension or termination of your access to the Campervan Bible platform.
Consumer Rights
We are committed to providing our services in a manner that complies with applicable consumer protection legislation. Nothing in these Terms and Conditions is intended to exclude, restrict or reduce any rights or remedies that you are entitled to under laws that cannot legally be excluded.
If you are using the Campervan Bible platform as a consumer, you will continue to benefit from any mandatory legal protections that apply to digital content, digital services, subscriptions or online purchases under the laws of your country of residence, to the extent that those protections cannot lawfully be limited or excluded.
Where any provision of these Terms and Conditions is inconsistent with mandatory consumer protection legislation, the relevant legal requirement will take precedence, but only to the extent necessary to resolve that inconsistency. The remainder of these Terms and Conditions will continue to apply.
Any limitation or exclusion of liability contained in these Terms and Conditions applies only to the extent permitted by applicable law and does not affect rights that are mandatory under consumer protection legislation.
Content Moderation
To help maintain a safe, respectful and reliable community, we may review user-generated content where this is reasonably necessary to enforce these Terms and Conditions, respond to complaints, comply with legal obligations or protect the integrity of the Campervan Bible platform.
Users may report content that they believe is unlawful, misleading, inaccurate or otherwise inconsistent with these Terms and Conditions. We will review reports in good faith and, where appropriate, investigate the circumstances before deciding whether any action is required.
Where we reasonably believe that content breaches these Terms and Conditions, infringes the rights of another person, creates legal or regulatory risk or could adversely affect our users or services, we may remove or restrict access to that content, limit certain account features or suspend the relevant account where this is reasonably necessary.
We are not required to remove or amend content simply because another user disagrees with it. Moderation decisions are made on the basis of the information available to us at the time, our legal obligations, the interests of our users and the need to maintain a safe and trustworthy platform.
Where reasonably practicable, we will seek to apply moderation measures that are proportionate to the nature of the issue and may provide an opportunity for the affected user to respond before permanent action is taken, unless immediate action is required to protect users, comply with the law or address an urgent security or safety concern.
Intellectual Property
The Campervan Bible platform, including its software, design, branding, logos, graphics, text, databases, functionality and other original content, is owned by or licensed to Campervan Bible and is protected by copyright, trade mark and other intellectual property laws.
Your use of the Campervan Bible platform does not transfer ownership of any intellectual property rights to you. Subject to these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable and revocable right to access and use the platform for your own personal, non-commercial purposes.
Unless we have given our prior written permission or the law allows otherwise, you must not copy, reproduce, modify, distribute, publish, sell, license, reverse engineer, create derivative works from or otherwise exploit any part of the Campervan Bible platform or its content.
Nothing in these Terms and Conditions prevents you from accessing or using the content that is made available to you through your membership in the normal course of using the platform for its intended purpose.
If you believe that material available through the Campervan Bible platform infringes your intellectual property rights, please contact us with sufficient information to allow us to investigate your concerns. We will review each notification carefully and, where appropriate, take action in accordance with applicable law.
Availability of the Services
We aim to keep the Campervan Bible platform available, secure and operating reliably at all times. However, as with any online service, we cannot guarantee uninterrupted availability or that every feature will always operate without delay, interruption or technical error.
From time to time, we may carry out planned maintenance, install software updates, improve existing functionality or introduce new features. Some of this work may temporarily affect the availability of parts of the platform. Wherever reasonably practicable, we will plan maintenance in a way that minimises disruption to users.
There may also be occasions where we need to suspend, restrict or modify some or all of the services without prior notice. This may be necessary to protect the security or integrity of the platform, respond to technical issues, investigate suspected misuse, comply with legal or regulatory obligations or carry out essential maintenance.
As Campervan Bible continues to develop, certain features, tools or services may be updated, replaced or discontinued. We will always seek to make changes in a way that supports the continued development of the platform while minimising unnecessary inconvenience to our users.
We are not responsible for interruptions or reduced availability caused by circumstances outside our reasonable control, including failures affecting internet service providers, mobile networks, cloud infrastructure, third-party software, payment providers or other external services on which the Campervan Bible platform relies.
Third-Party Services
The Campervan Bible platform relies on a number of trusted third-party services to provide certain features and support the day-to-day operation of our website and mobile application.
These services may include cloud hosting, payment processing, user authentication, interactive maps, analytics, email delivery, security tools and other technologies that help us deliver and improve our services.
Although we carefully select the providers that we work with, they operate independently from Campervan Bible and are responsible for the management, availability and security of their own services. We do not control their systems, internal processes or business operations.
In some cases, your use of a particular feature may also be subject to the terms, privacy policy or other conditions published by the relevant third-party provider. We encourage you to review those documents where they are applicable.
From time to time, we may add, replace or remove third-party providers as our services develop or where this is reasonably necessary for operational, technical, legal or commercial reasons. Where a change materially affects the way your personal information is processed, we will update our Privacy Policy as appropriate.
Campervan Bible is not responsible for interruptions, delays, outages or other failures that arise solely from the operation of third-party services outside our reasonable control. However, we will take reasonable steps to minimise disruption to our users where practical and work with our providers to resolve issues affecting the platform whenever possible.
Updates to the Platform
We are continually developing the Campervan Bible platform to improve performance, enhance security, introduce new features and respond to changes in technology, legal requirements and the needs of our users.
From time to time, we may release updates, bug fixes, security patches or improvements that are necessary for the continued operation of the platform. Some updates may be installed automatically where this is reasonably necessary to maintain compatibility, improve security or ensure that the services continue to operate as intended.
As the platform evolves, we may modify, replace or discontinue certain features, tools or services. Where reasonably practicable, we will seek to minimise unnecessary disruption and provide reasonable notice of significant changes that are likely to have a material effect on your use of the platform.
We may also introduce new features or services that are subject to additional terms or specific requirements. Where this applies, those terms will be made available before you use the relevant feature.
Nothing in these Terms and Conditions guarantees that any particular feature, service or functionality will remain available indefinitely. The continued development of the Campervan Bible platform may require changes to ensure that it remains secure, reliable and suitable for the needs of our users.
Suspension and Termination
We may suspend, restrict or terminate access to all or part of the Campervan Bible platform where we reasonably believe that this is necessary to protect our users, maintain the security or integrity of our services, comply with legal or regulatory obligations or safeguard our legitimate business interests.
This may include situations where you have materially breached these Terms and Conditions, provided false or misleading information, engaged in fraudulent or unlawful activity, created a security risk, misused the platform or where continued access could adversely affect other users or the operation of our services. We may also take action where we are required to do so by law, a court or another competent authority.
Where reasonably practicable, we will explain the reasons for any suspension or termination and, where appropriate, provide you with an opportunity to resolve the issue before permanent action is taken. This may not be possible where immediate action is necessary to protect users, respond to a security incident or comply with a legal obligation.
You may stop using the Campervan Bible platform at any time and may close your account in accordance with these Terms and Conditions. If you have an active subscription, you should also complete the relevant cancellation process with the applicable payment provider, as closing your account does not automatically cancel recurring subscription payments.
The suspension or termination of your account does not affect any rights, obligations or liabilities that arose before the date on which access ended. This includes outstanding payment obligations, accrued rights, intellectual property provisions, limitations of liability and any other terms that are intended, either expressly or by their nature, to continue after termination.
Disclaimer
We aim to provide a reliable and useful platform that helps users discover locations, plan journeys and share their travel experiences. However, the Campervan Bible platform is provided on an "as available" and "as is" basis, and we cannot guarantee that every feature, service or item of content will always be available, uninterrupted or free from errors.
While we make reasonable efforts to maintain accurate and up-to-date information, much of the content available through the platform is provided by users or obtained from third-party sources. For that reason, we cannot guarantee that locations, reviews, photographs, recommendations, routes or other information will always be complete, accurate, current or suitable for your particular circumstances.
Information made available through the Campervan Bible platform is provided for general informational purposes only. It is intended to assist users in planning their journeys and making informed decisions, but it should not be relied upon as professional, legal, financial, technical or safety advice.
You remain responsible for assessing the suitability of any location, campsite, route, parking area, service or recommendation before relying on it. This includes making your own decisions regarding vehicle safety, weather conditions, road restrictions, local regulations and any other matters that may affect your journey.
Nothing in these Terms and Conditions excludes, restricts or limits any rights, guarantees or remedies that cannot lawfully be excluded under applicable consumer protection legislation or any liability that cannot legally be limited under applicable law.
Limitation of Liability
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful. This includes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited under applicable law.
Subject to the paragraph above, Campervan Bible will not be responsible for indirect or consequential loss arising from or in connection with your use of the platform. This includes loss of profits, revenue, business opportunities, goodwill, anticipated savings, data or business interruption, except where such liability cannot lawfully be excluded.
To the fullest extent permitted by law, our total liability arising out of or in connection with these Terms and Conditions or your use of the Campervan Bible platform, whether in contract, negligence or otherwise, will not exceed the total amount that you have paid to Campervan Bible during the twelve months immediately preceding the event giving rise to the claim.
Nothing in this section affects any rights or remedies that you are entitled to under mandatory consumer protection legislation, nor does it exclude or limit any liability that cannot legally be excluded under applicable law.
Indemnity
You agree to indemnify Campervan Bible, together with its owners, directors, employees, contractors and service providers, against any losses, liabilities, damages, costs and reasonable legal expenses that arise directly from your breach of these Terms and Conditions, your unlawful use of the Campervan Bible platform or your infringement of the intellectual property rights, privacy rights or other legal rights of another person.
This indemnity applies only to the extent that the relevant loss or liability results from your actions or omissions and only where such indemnification is permitted by applicable law.
Nothing in this section excludes or limits any rights or protections that you are entitled to under mandatory consumer protection legislation or any liability that cannot legally be limited or excluded.
Privacy
Protecting your personal information is an important part of how we operate the Campervan Bible platform. We are committed to handling personal information responsibly and in accordance with applicable data protection legislation.
The way we collect, use, store, share and protect personal information is explained in our Privacy Policy, which forms an integral part of these Terms and Conditions. By creating an account or using the Campervan Bible platform, you acknowledge that your personal information will be processed as described in that Privacy Policy.
Our Privacy Policy also explains the categories of personal information we collect, the purposes for which it is used, the legal bases we rely upon, the third-party service providers that support our services, your privacy rights and the ways in which you can contact us if you have any questions about the processing of your personal information.
Where these Terms and Conditions and our Privacy Policy address the same subject matter, they should be read together. If there is any inconsistency relating specifically to the processing of personal information, the Privacy Policy will apply to the extent necessary to explain our data protection practices.
Electronic Communications
By creating an account or using the Campervan Bible platform, you agree that, where permitted by applicable law, we may communicate with you electronically. This may include emails, in-app notifications, account messages or other electronic communications relating to your account, your membership, security, service updates, changes to our policies or the operation of the Campervan Bible platform.
Where applicable law requires your consent before sending particular types of electronic communications, we will obtain that consent and provide you with any choices or controls required by law.
Changes to these Terms and Conditions
From time to time, we may update these Terms and Conditions to reflect changes to the Campervan Bible platform, new features, developments in technology, changes in applicable law or the way we operate our business.
Where an update is likely to have a material effect on your rights or obligations, we will take reasonable steps to bring it to your attention before the revised Terms take effect. Depending on the nature of the change, this may include providing notice through the website, the mobile application, your account or by email where appropriate.
The most recent version of these Terms and Conditions will always be available through the Campervan Bible website and mobile application. The date of the latest revision will also be displayed so that you can easily identify when changes have been made.
By continuing to use the Campervan Bible platform after updated Terms have come into effect, you agree to be bound by the revised Terms to the extent permitted by applicable law. If you do not agree with the changes, you should stop using the platform and, where applicable, cancel any active subscription before the revised Terms take effect.
Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be interpreted, so far as possible, in a way that most closely reflects its original purpose while remaining legally effective.
If the relevant provision cannot be interpreted in that way, it will be treated as removed from these Terms and Conditions only to the extent necessary. The validity and enforceability of the remaining provisions will not be affected and they will continue to apply in full force and effect.
Waiver
If we delay, choose not to exercise or only partially exercise any right or remedy available to us under these Terms and Conditions, this will not prevent us from exercising that right or remedy at a later time or from exercising any other right or remedy available to us.
Any waiver of a provision of these Terms and Conditions will be effective only if it is made expressly and confirmed in writing. A waiver applying to one particular situation does not mean that the same or any other provision has been waived in relation to any future circumstances.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Cookie Policy and any other policies or notices expressly referred to within them, constitute the entire agreement between you and Campervan Bible in relation to your access to and use of the platform.
They replace all previous discussions, correspondence, understandings and agreements relating to the same subject matter. You acknowledge that, in entering into these Terms and Conditions, you have not relied on any statement, representation or promise that is not expressly set out in these documents.
Nothing in this section excludes or limits liability for fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited under applicable law.
Governing Law
These Terms and Conditions, together with any dispute or claim arising out of or in connection with them or your use of the Campervan Bible platform, are governed by the laws of England and Wales.
If you are using the Campervan Bible platform as a consumer, you will continue to benefit from any mandatory consumer protection rights that apply in the country where you are habitually resident, to the extent that those rights cannot lawfully be excluded.
Subject to those mandatory consumer rights, the courts of England and Wales will have jurisdiction to resolve any dispute arising out of or in connection with these Terms and Conditions or your use of the Campervan Bible platform.
Dispute Resolution
We believe that most questions, concerns and disagreements can be resolved quickly through open communication. If you experience a problem with the Campervan Bible platform or have a complaint about our services, we encourage you to contact us first so that we have an opportunity to investigate the matter and work with you to reach a fair and practical solution.
We will consider all reasonable enquiries in good faith and aim to respond within a reasonable period. While we cannot guarantee that every issue can be resolved to your satisfaction, we will make reasonable efforts to address concerns promptly and fairly.
If a dispute cannot be resolved through informal discussions, either party may refer the matter to the courts that have jurisdiction under these Terms and Conditions and applicable law.
Nothing in this section prevents either party from seeking urgent interim, equitable or other legal remedies where this is reasonably necessary to protect its legal rights, confidential information, intellectual property or other legitimate interests.
